The design is clearly RIC-influenced but I can't decide whether it's over the line or not. If you're talking about a 4004 then I'd have to say it's a faker.

When they do such a bad job of impersonating, I don't understand why they go through the effort. In the same vein, I would never mistake this gentleman for Marilyn Monroe...

Eeeyuck.....not my cup of tea; Maybe when I was 17, I would have liked it. However, I've got a couple of Japanese ESP's, and they do make some very good quality instruments.

My attorney opinion:
{1} Probably not close enough for a trademark variation, although the shape of the top bout comes very close.
{2} Probably not sold directly in the US anyway, so it's likely impossible to get jurisdiction under the Lanham act, and,
{3} at $3800, unlikely to displace the 4003/4004 in the market anyway.
