It is, but it's not like Rickenbacker has an orbital satellite that melts people as soon as they make one. Not much to be done about it.

I've heard they actually have one, but melting people isn't nice so they're trying to fine tune it to just melt the infringing instruments...

Co-incidently, I've spoken with Nigel Thornbory (designer of the Ashbory bass) this morning, having just bought one of his instruments direct from him, and he's confirmed that the Rick shaped instrument is not a genuine Ashbory bass.
