There is a new listing for a Townshend Rick on Ebay but I'm confused about it's authenticity, shouldn't it be smashed and broken?

No, this guitar appears to be one of the Pete Townshend signature models, which basically recreated the Rose Morris export Model 1998 that he played early on in The Who. (He also played other Rick models, but this one is the only signature model made by Rickenbacker.). If I remember correctly, there was a limited run of 250 of these guitars made. They're becoming quite collectible.
