You may have to contact eBay directly rather than open a case (but quote your item number) and I think this is worth pursuing.

I did report the seller yesterday, you have to do so by phone. However, all Ebay will do is send a "reminder" to the seller that he should make the item available. I think only for repeating violations there may be further action like the cancellation of the account. All the rest needs to be dealt by a lawyer, if you want to go that route...
