They can't. Ebay is filled with wiley, street-smart jerks who play the angles. You can always tell when you ask a nice question and get a canned response worded to keep you on the outside...
Then there are the outright jerks, who make no bones about it.

Is the manufacture of these guitars illegal? Can RIC not just sue Tokai?

Actually, calling the company "prickenbacker" in print is libel, and the idiot can (should!) be sued (all that RIC would have to do is present a copy of the auction as evidence, done deal!). BTW, I think that it is against eBay policy for an auction to contain libelous material, because eBay doesn't want to be sued as an accomplice.
